If you believe you have been discriminated against by a notary public you can submit a complaint form to the New Jersey Department of the Treasury.
The Unauthorized Practice of Law
The unauthorized practice of law (UPL) is when a notary public offers legal advice without being licensed as an attorney stated in N.J.S.A. 2C:21-22; without the title of a licensed attorney a notary public is only to serve as an impartial witness to notarial acts, verify the signer’s identity, administer oaths, take acknowledgements of legal and real estate documents, witnessing signatures, attesting that copies of documents are true copies, and to confirm the signer’s willingness and awareness to sign the document. Notaries are not permitted to give legal advice, accept fees for legal advice, or answer questions about a legal matter or act as an immigration consultant. Notaries are prohibited to offering an opinion about the legality or effect of a document or recommending the type of notarization and/or certificate required. Notaries are not allowed to draft, complete, analyze, prepare, or fill out any documentation. Notaries who engage in the unauthorized practice of law can face serious penalties including fines, loss of commission, criminal conviction, fourth degree charge, civil lawsuits, disciplinary actions, and damage to his/her reputation.
